アプリ利用者様が’myumyu factory Japan’作成アプリをご利用いただく際の利用規約をご説明します。アプリをインストールすることにより、本利用規約をご承諾いただいたものとします。
第1条 ( 権利許諾と著作権 )
アプリ利用者様は、’myumyu factory Japan’により提供される本アプリを、本アプリがインストールされた端末上で、非独占的に使用することができます。本アプリの著作権は、’myumyu factory Japan’、あるいは’myumyu factory Japan’へのソフトウェア供給者が所有しています。
第2条 ( 禁止事項 )
アプリ利用者様は、’myumyu factory Japan’の文書による同意なしに、本アプリを複製したり、改変したりすることはできません。ただし、本アプリをインストールする際の複製、バックアップ目的での複製については、この限りではありません。これらの場合でも、アプリ利用者様は複製したソフトウェアのすべてに、本アプリと同一の著作権表示をするものとします。アプリ利用者様は、’myumyu factory Japan’の文書による同意なしに、本アプリあるいは本アプリの複製物(改変したものを含む)を、全体または一部にかかわらず、第三者に使用させ、もしくは譲渡や転売することはできません。また、本アプリを貸出業務に使用することもできません。
第3条 ( 仕様変更 )
‘myumyu factory Japan’は、アプリ利用者様の事前の許可、あるいは、アプリ利用者様への事前の通告なしに、本アプリの仕様を変更することがあります。
第4条 ( 無保証と免責 )
‘myumyu factory Japan’は、本アプリの機能がアプリ利用者様の要求を満たすこと、本アプリの運用が中断されないこと、およびその運用結果に誤りのないことを保証するものではありません。’myumyu factory Japan’は、本アプリの性能もしくは運用結果に関連して発生する直接的、間接的損害について、賠償責任を負わないものとします。
第5条 ( 一般事項 )
本規約は、消費者契約法など消費者保護法規によりアプリ利用者様に保障された権利を制限するものではありません。本規約においては、日本国法を管轄法とします。本規約の条項の一部が、法令の定めにより無効とされた場合も、他の条項は効力を有するものとします。本規約に関する訴訟については、’myumyu factory Japan’所在の裁判所をもって第一審の専属的合意管轄裁判所とします。
I will explain the terms of use when the application user uses the application created by’myumyu factory Japan’. By installing the app, you agree to these Terms of Use.
Article 1 (License and copyright)
App users can use this app provided by’myumyu factory Japan’non-exclusively on the terminal on which this app is installed. The copyright of this application is owned by the software supplier to’myumyu factory Japan’or’myumyu factory Japan’.
Article 2 (Prohibited matters)
App users may not copy or modify this app without the written consent of’myumyu factory Japan’. However, this does not apply to duplication when installing this application and duplication for backup purposes. Even in these cases, the application user shall display the same copyright notice as this application on all the duplicated software. The app user may use this app or a copy of this app (including modified ones) by a third party, in whole or in part, without the written consent of’myumyu factory Japan’. Or it cannot be transferred or resold. In addition, this application cannot be used for lending business.
Article 3 (Specification change)
‘Myumyu factory Japan’ may change the specifications of this application without the prior permission of the application user or the prior notification to the application user.
Article 4 (No warranty and disclaimer)
‘Myumyu factory Japan’ does not guarantee that the functions of this application will meet the requirements of the application users, that the operation of this application will not be interrupted, and that the operation results will be correct. ‘Myumyu factory Japan’ shall not be liable for any direct or indirect damages caused in connection with the performance or operation results of this application.
Article 5 (general matters)
This agreement does not limit the rights guaranteed to app users by consumer protection laws such as the Consumer Contract Law. In this agreement, the law of Japan is the jurisdiction. Even if some of the provisions of this Agreement are invalidated by law, the other provisions shall remain in effect. For proceedings related to this agreement, the court located in’myumyu factory Japan’will be the exclusive agreement jurisdictional court of the first instance.
